These terms and conditions comply with your statutory rights. The content of the pages of this website is for your general information and use only. Please read carefully all of the terms and conditions of this user agreement. These terms and conditions apply to the sale and services or supply of all products by Emmi's Kitchen. By confirming your order with us, you agree to be legally bound by these terms and conditions. Please note that these conditions may be subject to change in the future. We will inform you if this is the case.

How to Order Our Products
​
Weekly products will be stocked on the website every Sunday. Seasonal, themed or limited edition stock will be stocked on the website in limited amounts due to work load sustainability. These products will have their own specific restock date, times, collections and delivery estimates. General products will be read for collection or dispatched on Thursdays. If you require a layer cake or a custom order please contact us to arrange details such as event date so we can arrange for your order to be added to the schedule. We recommend a minimum of two week notification to complete your custom order. Please note slots like these are subject to limitation and on a first come first serve basis. The easiest way to order any of our products like these is to make an order through our website (www.emmiskitchen.com) and request any personalisation or changes (may needed) at the time of check out. Or you may email (hello@emmishomemadekitchen.com) Orders can be made via DM on Instagram or on Facebook Messenger @emmishomemadekitchen but we suggest using the website for the quickest order process.

Payment & Deposit
We take payment via our website using all debit or credit cards, bank transfers, and PayPal. All orders from our website require full payment at the checkout. Or paid via a secure bank link through DM before the order is secured.

Product Information
​
Images of products should not be shared unless Emmi's Kitchen is given mention and credit. All products are handmade and created to the highest of standards. Any description applied to the products is only given by way of identification and does not constitute a sale by description. Any image provided as part of the description of similar products is given for illustrative purposes only. Given the nature of the products, minor variations of colour, taste and design may apply.

Alteration
​
If you have any queries or need to make any changes to an order you must contact Emmi's Kitchen immediately. Alterations and amendments must be submitted in writing and agreed by both parties.
The alteration will be assessed if the alteration can be completed. An alteration or change to order may be subject to an additional charge. Accepting alterations is at the discretion of Emmi's Kitchen. Alterations requested less than 3 days before completion will not be agreed to. It is your responsibility to check any quotes and invoices thoroughly before making payment. Emmi's Kitchen reserve the right to change the design at any point if circumstances beyond the business's control compromise the quality of the finished product. You will be notified if any of these changes are needed and an agreement will be completed to ensure you still intend to move forward with the order.

Delivery & Collection Service
​
Deliveries will be made on Thursdays each week, unless your order is part of a seasonal collection or custom order.
You will be notified of the delivery date and estimate arrival time as well as provided with a tracking number through
Royal mail.
Collection times will need to be agreed by contact through the website, email or via social media.
This is subject to availability, changes may be made if circumstances out of the business's control happen. You will be notified immediately. If you need to change a collection time please contact Emmi's Kitchen as soon as possible so a new arrangement can be made for you. If you have requested a specific delivery address and have not selected the correct delivery option, or provided the right details at the checkout. If you contact Emmi's Kitchen immediately corrects could possibly be made. However this not always possible due to how far the order has been processed. Emmi's Kitchen will do everything it can to help you with this. Although it is the customer's responsibility to assure that the correct information is given at the check out. Customers should also be aware that they will be collecting from a HOME ADDRESS in Burton Upon Trent. We assume no responsibility for any loss or damages caused by customer after collection. We will not issue any refunds upon errors or misrepresentations created by the customers.
A product that cannot be delivered or collected due to an error or misrepresentation from the customer, shall be given to a charity of our or customer's choice on the following day. Due to the perishable nature of the items, we will not be able to store your product for more than 42 hrs from the delivery or collection slot given. ​

Damages
​
We cannot be held liable for any damages to the product once collected, as well as once dispatched. If there is a problem with your products on arrival through the postal service. If substantial evidence is provided surrounding issues such as late arrival, products being lost or damaged. There may be an option to resolve these matters at the business's digression.
Emmi's Kitchen do offer prearranged collection at the Home Bakery, in Burton Upon Trent. A product collected from Emmis Kitchen requires a signed delivery note on arrival to confirm you are happy with the condition of the product and it has been collected successfully.
The collection vehicle should have a flat surface and be clean and tidy. Please do not place the products on a seat in the car, seats are slanted and can damage the baked goods. The products should be placed either in the boot or the footwell of the car on a non-slip mat. Extra care should be taken when driving as some elements may be delicate. Emmi's Kitchen cannot take any responsibility for damage to products when collected and transported by the customers. The products can be very fragile so we advise to drive very slowly and carefully. All our products are fragile and require care and attention when handling, storing and displaying. Please pay careful attention to our "Cake Care" instructions.

After Delivery
​
Products should be stored in a cool dry place for up to the date stated on the best before sticker provided. Freezing products is not recommended. Goods placed outside are liable to react to the temperature. In hot or humid weather there is risk of melting or damage to the goods. Please note, once products have been cut, the shelf life will be reduced. We recommend extreme caution if you are considering items with chocolate for a summer party or event (May-September). We cannot accept responsibility for any melting of the products once it has left our possession, as we have no control over the environment temperature. However, we can advise you of products that are less susceptible to melting and do everything within Emmi's Kitchen's control to reduce the impact on the products.

Allergens
​
Emmi's Kitchen is NOT an allergy-free kitchen. The Kitchen cannot guarantee that the products produced are free from ingredients that may affect those with food allergies. At Emmi's Kitchen we recognise the seriousness of food allergies and we recommend that you consider our allergens information before you place an order. You have agreed to notify your guests of allergen risks. Emmi's Kitchen has the right to decline any orders for clients with serious food allergies. Emmi's Kitchen will not assume any liability for adverse reactions to the products. Products may contain wheat/cereals containing gluten, eggs, milk, tree nuts, peanuts, sesame, mustard, soybeans, lupin, sulphur dioxide/sulphites. Emmi's Kitchen's products are freshly prepared in the bakery, and ingredients come from factories that handle other allergens. Whilst Emmi's Kitchen holds allergens and awareness in the highest priority and the ingredients suppliers used take precautions needed, we cannot guarantee that any product is free from allergens due to the risk of cross-contamination.

Non-Edible Items, Ornaments, and Toppers.
All non edible items will be stated on products in the order description on purchase and collection/delivery. It is also the responsibility of the recipient to ensure these items are dealt with and handled safely especially around young children. ​

Colours & Design
​
Whilst an exact match of a provided picture cannot be guaranteed Emmi's Kitchen works tirelessly to meet your desires upon purchase as far as possible. Creating a baked goods is a handmade art form and may be subject to variations. This also applies to food colourings and icings. Different sugar substrates take on colour differently. Everything possible is done to make substrates match to each other chosen, but sometimes it is not possible to make a 100% perfect colour match and some colours are just not achievable using food-grade dyes. You must check everything is correct upon purchase if specific colours are requested. We cannot match a “verbal” colour or a colour sent via an electronic device, as all monitors display colour differently. It may not be possible to create exact specifications when decorating the products. However, Emmi's Kitchen will ensure you are happy with the design before the order process if complete.​
​Photography
Photographs of your products may be taken by Emmi's Kitchen to use for marketing, advertising, and promotional purposes, this is within the rights of the business. If you take photos of products made by Emmi's Kitchen it is required of you to give credit to the business. Any photography taken of the products by customers should not be used in any other promotional content by anyone else apart from Emmi's Kitchen itself.

Zero Tolerance

Emmi's Kitchen will not tolerate abuse in any form towards staff including delivery drivers. Staff do everything they can to ensure all circumstances and requirements that the customer require are catered to with compassion, care and professionalism. Staff are willing to help support with any concerns and they will do everything possible to make sure customer satisfaction is maintained. Emmi's Kitchen works endlessly to be inclusive but the business WILL NOT tolerate any form of abuse including persistent or unrealistic demands that cause stress to staff.
This includes requests at inappropriate times out of work hours.
Such behaviour and violation of any of these terms and conditions may result in your order being cancelled.
Refunds & Cancellations

Deposits are non-refundable and non-transferable under any circumstances due to any loss of business that is caused by having to turn away other customers on specific slots given to you. Emmi's Kitchen will not refund the cost of any orders cancelled with less than 48hrs notice. Orders paid in full and cancelled with more than 48hrs notice may be subject to a partial or full refund dependant of circumstance. In the unforeseen circumstances that Emmi's Kitchen may have to cancel your order for any reason, then you will be informed straight away and discussion will be had to arrange a suitable alternative. If you do not wish to accept our suggested alternative, then a refund may be applicable.
